Mandamus proceedings commenced upon the petition of Wayne Underwood, a minor, nineteen years of age, by his guardian ad litem
for the purpose of compelling the Commissioner of the Motor Vehicle Department to reinstate his motor vehicle operating privileges. The circuit court by its order issued an alternative writ of mandamus requiring the commissioner to either issue motor vehicle
operating privileges to Wayne Underwood or show cause to the contrary. A hearing was held on the order to show cause and on
March 7, 1963, judgment was entered issuing a peremptory writ of mandamus directing the commissioner to restore Wayne Underwood's
motor vehicle operating privileges. The commissioner appeals from the judgment.
