The issue at trial in this action was whether it was the homeowner or the contractor who breached a written contract to remodel several rooms in a home. The jury returned a special verdict finding that although the contractor had not substantially performed under the contract, he had been prevented from doing so by the homeowner. The jury awarded $2,956.40 in damages to the contractor, essentially the balance of the contract price. The homeowner filed a motion for judgment n.o.v. or for a new trial, which was denied. The homeowner appeals the judgment and denial of her motion. She contends that the jurys verdict is contrary to the law and the evidence presented. She also claims that the trial court erroneously rejected one of her proposed jury instructions, excluded evidence, and awarded costs and attorney fees to the contractor.
