Action by the plaintiff against the defendant corporation to recover commissions alleged to be due for the year 1955 on an oral contract of employment. The action was commenced in the civil court of Milwaukee county. By answer the defendant admitted employing the plaintiff under an oral contract at a weekly salary but denied that there was any contract or agreement to pay plaintiff any commissions in addition thereto. By way of an affirmative defense the defendant alleged that the agreement, if as claimed by the plaintiff, was void under the statute of frauds. The defendant also counterclaimed against the plaintiff for work and materials furnished to him during the construction of a new home upon which there was a balance due.
